Terms of Service
The agreement between you and Comerz.ai when you use the platform. Written to be read, not skimmed past.
1 Who these terms are for
Comerz.ai is an AI-first product catalog platform for e-commerce operators, engineered and operated in Switzerland ("Comerz.ai", "we", "us"). These terms govern your use of the Comerz.ai application and website. By creating an account or using the service you accept them. Comerz.ai is a business tool: you confirm that you use it for your company or shop, not as a consumer.
2 The service
Comerz.ai helps you manage product catalogs and publish them to your connected sales channels, with AI assistance that always waits for your review. The service is in active development: features may be added, changed, or removed, and we announce material changes in the app or by email. If these terms and the in-app Conduct of Service ever conflict, these terms govern.
3 Your account
You need an account with accurate details and a verified email address. Keep your credentials safe; activity under your login is your responsibility. Workspaces are managed by their owners and admins, who control member access. Tell us right away at support@comerz.ai if you suspect unauthorised access.
4 Your content
Everything you import or create in your workspace (products, images, documents, settings) stays yours. You grant us the limited rights needed to store, process, and transmit that content to run the service: sending it to the AI providers listed in the Privacy Policy when you use AI features, and to your connected channels when you sync. You are responsible for having the rights to the content you upload and for the products you sell.
5 Acceptable use
The Conduct of Service, shown before checkout and available in the app, is the plain-language rule set for using Comerz.ai: lawful commerce only, only stores you are authorised to operate, no infringing or deceptive content, no abuse of the service. It forms part of these terms.
6 AI features
AI outputs (titles, descriptions, translations, suggestions, mappings) are drafts generated for your review. We do not guarantee their accuracy. You remain the publisher of everything you save or sync. AI usage draws on the credit allowance of your plan, and fair-use limits protect the service from abuse.
7 Trial, fees, and payment
Every plan starts with a 30-day free trial and requires a valid payment method. Payments run through Stripe; we never store card data. Unless you cancel before the trial ends, the plan converts to a paid subscription at the listed CHF price and renews monthly. You can change plans, update payment details, download invoices, or cancel anytime in the Stripe billing portal; cancellation takes effect at the end of the paid period. We may change prices with at least 30 days' notice to your billing email, applying from your next renewal.
8 Term, suspension, and ending the service
You can stop using Comerz.ai and cancel at any time. We may limit, suspend, or terminate accounts that break these terms, harm other customers, or endanger the service, contacting you first when reasonable. When a workspace ends you can export your catalog beforehand, and we delete workspace data as described in the Privacy Policy. If we ever retire the service, paid plans get at least 60 days' notice.
9 Availability and support
We run Comerz.ai on Swiss cloud infrastructure and aim for high availability, but during the beta we do not commit to a formal SLA. Maintenance is announced when it affects you. Support is by email at support@comerz.ai.
10 Warranties and liability
The service is provided as available, without warranties beyond what Swiss law requires. To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the event giving rise to the claim, and we are not liable for indirect damage such as lost profit. Nothing in these terms limits liability for intent or gross negligence, which cannot be excluded under Swiss law.
11 Data protection
How we handle personal data is described in the Privacy Policy. In short: hosted in Switzerland, processed under the Swiss FADP and the GDPR where it applies, never sold.
12 Changes to these terms
We may update these terms as the product evolves. For material changes we notify you in the app or by email at least 30 days before they take effect; using the service after that means you accept the new version. The current version always lives at comerz.ai/terms.
13 Governing law and jurisdiction
These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Exclusive place of jurisdiction is the seat of the operator of Comerz.ai in Switzerland.
